Copyright Office Announces Cost of Living Adjustment for 17 U.S.C. 118 Compulsory License

The Copyright Office of the Library of Congress announces a cost of living adjustment of 2 percent in the royalty rates paid by colleges, universities, or other nonprofit educational institutions that are not affiliated with National Public Radio for the use of copyrighted published nondramatic musical compositions in the BMI and ASCAP repertories. The cost of living adjustment is based on the change in the Consumer Price Index from October 2001 to October 2002. If no comments are received regarding the proposed amendments to 37 C.F.R. 253.5 and 253.10 announced in the October 30, 2002, Federal Register notice (67 FR 66090) and the final rules are published before January 1, 2003, the cost of living adjustments in this notice will become effective on January 1, 2003. Copyright Office Announces Alternative Methods to File 2002 DART Royalty Claims

Due to continuing delays in the receipt of mail, the Copyright Office of the Library of Congress is announcing alternative methods to file claims to the DART royalty funds for the year 2002. To ensure that their claims are timely received, claimants are encouraged to file their DART claims online or by fax, utilizing the special procedures described in the Federal Register notice. Claims filed by fax must be received in the Office no later than 5 p.m. E.S.T. on February 28, 2003. DART forms will be posted later on the Office website.

Claims filed online must be received by the Office's server no later than 11:59 p.m. E.S.T. on February 28, 2003. Forms may also be hand-delivered to the Office or sent by mail. However, the Office strongly urges claimants not to use the mail as a means of filing their claims to the 2002 DART royalty funds. Solely in the case of filing claims to the 2002 DART royalties by fax or online, the Office waives the provision requiring an original signature of the claimant or of a duly authorized representative of the claimant (37 C.F.R. 259.3(b)).
